Agreement
A.1 These terms apply when you ask Digital Guppy (ABN 54 713 014 534) to enable WHOIS ID Protection for your domain. You must be authorised to act for the domain holder. Read these terms together with your Digital Guppy service agreement, our Privacy Policy and the applicable domain registration terms.
A.2 Digital Guppy arranges this service through an upstream registrar and privacy provider. The provider’s WHOIS ID Protection terms also apply. These terms describe our customer relationship; they do not replace the provider’s agreement or mandatory registry and ICANN requirements.
1. The service and your domain
1.1 WHOIS ID Protection uses alternative contact details in public domain registration records. A privacy service substitutes contact details while leaving you as the registered holder. A proxy service instead lists the provider as the registered holder, with your rights to use the domain governed by the service agreement.
1.2 The service we arrange may list the upstream privacy service, rather than Digital Guppy, in public records. Your contractual rights to use, renew, transfer, manage or cancel the domain remain subject to the applicable registration and provider terms.
1.3 The service is available only where supported for your domain. It does not make your activity anonymous, remove information already published elsewhere, or replace your responsibility for the domain and its use.
2. Your responsibilities
2.1 Provide accurate domain-holder and contact information. Tell us about changes within five days and respond within five days to requests to verify that information, or sooner where a binding deadline applies.
2.2 Keep your account credentials and transfer codes secure, monitor your contact mailbox, and tell us promptly about unauthorised access. Ensure anyone managing the domain for you has appropriate authority.
2.3 Do not use the service to hide unlawful activity, impersonation, malware or infringement of another person’s rights. You must comply with applicable domain registration rules and dispute procedures.
3. Disclosure and suspension
3.1 Public registration data is governed by the applicable registry and registrar requirements, including ICANN’s Registration Data Policy where relevant. Privacy protection does not prevent lawful requests for non-public information or remove the provider’s recordkeeping duties.
3.2 The provider may disclose protected details, remove protection or take action concerning the domain in response to legal requirements, domain disputes, abuse or a breach of its terms. Removal of protection may expose previously protected details, subject to the publication rules then applicable.
3.3 Digital Guppy will pass on relevant requests and notices we receive. We cannot prevent a registrar, registry or provider from carrying out an action it is legally or contractually entitled to take. Where permitted and reasonably practicable, we will explain the action and any steps available to you.
4. Communications and charges
4.1 The provider forwards eligible correspondence to your nominated contact details. It may filter or discard spam and other unsolicited messages. Keep those details current and check spam folders as well as your inbox.
4.2 Digital Guppy’s charges, if any, will be identified in your order or service agreement. Any proposed additional charge for handling a dispute or unusual administrative work will be explained before Digital Guppy undertakes chargeable work, except where your existing agreement expressly authorises it.
4.3 Disabling protection does not itself create a refund entitlement. Any refund depends on the applicable agreement and your statutory rights.
5. Contact and notices
5.1 For support, use your Digital Guppy client portal. Send legal notices, abuse reports or rights-infringement complaints to [email protected]. Include the domain, your contact details, your authority to act and enough information to explain the issue. We may refer the matter to the relevant provider.
6. Responsibility and consumer rights
6.1 Responsibility for loss, claims and any indemnity is governed by your applicable Digital Guppy service agreement and the provider terms. This document does not introduce a separate unlimited indemnity in favour of Digital Guppy.
6.2 Nothing here excludes rights or remedies that cannot lawfully be excluded, including applicable Australian Consumer Law guarantees. Any limitation, cancellation provision or refund condition operates subject to those rights.
7. Ending the service and changes
7.1 You may ask Digital Guppy to disable protection. Cancelling protection does not cancel the domain registration, hosting or other services. Before doing so, consider which contact details may become public.
7.2 We may update these terms to reflect changes to the service or applicable requirements. We will notify you of material changes and their effective date before they apply, except where an earlier change is required by law or a binding provider requirement. Changes will not retrospectively remove accrued rights.
7.3 If you do not accept a change, contact us to discuss disabling protection or other available options. Any charges, cancellation rights and refunds remain subject to your agreement and applicable law.
